NASET Terms of Service

1. Agreement to Terms
These Terms of Service (“Terms”) are a legally binding agreement between you and NASET (“we,” “our,” “us”) governing your access to and use of our website, educational resources, courses, certification programs, membership services, and all related products (collectively, the “Services”).
BY ACCESSING OR USING OUR SERVICES, YOU EXPLICITLY AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU ARE PROHIBITED FROM ACCESSING OR USING THE SERVICES.
2. Eligibility
You must be at least 18 years of age and have the legal capacity to enter into these Terms. If you are accessing the Services on behalf of a company, school district, or other legal entity, you represent and warrant that you have the authority to bind such entity and that the entity accepts these Terms.
3. Account Registration
To access certain features, you must register for an account. You agree to:
- Provide accurate, complete, and current information
- Keep your information updated
- Accept all risks of unauthorized access to your account
- Be solely responsible for all activity under your account
- Notify us immediately of unauthorized use or security breaches
We reserve the right to suspend, terminate, or refuse service to anyone for any reason, including false information or violation of these Terms.
4. Payment Terms & Strict No-Refund Policy
4.1 Courses & Certifications – Absolutely Non-Refundable
ALL FEES FOR COURSES, BOARD CERTIFICATIONS, PROFESSIONAL DEVELOPMENT PROGRAMS, AND ANY EDUCATIONAL CONTENT ARE FINAL AND NON-REFUNDABLE UNDER ALL CIRCUMSTANCES.
By purchasing any course or certification, you acknowledge and agree that:
- No refunds will be issued for any reason, including but not limited to change of mind, inability to complete, technical issues, dissatisfaction, personal or financial hardship, employment changes, unmet expectations, or duplicate purchases.
- Immediate access equals delivery. Once payment is processed, access to digital materials constitutes complete fulfillment of our obligations, whether or not you use the content.
- You waive any statutory cooling-off or withdrawal rights.
- No partial refunds for partial use or non-completion.
- Purchases are non-transferable and non-exchangeable.
4.2 Membership Fees
Annual membership fees are non-refundable except at NASET’s absolute discretion. Requests must be made in writing within seven (7) days of purchase. Any approved refund is a one-time courtesy and does not waive future enforcement of this policy.
4.3 Institutional & Group Purchases
Institutional and group purchases (including bulk licenses) are non-refundable once access credentials or materials have been provided. Access may only be used by the agreed number of users; exceeding licensed capacity constitutes a material breach.
4.4 Payment Authorization & Chargebacks
By providing payment information, you:
- Authorize us to charge your payment method immediately
- Confirm you understand the non-refundable policy
- Agree not to initiate chargebacks; doing so is a breach of contract
Any chargeback attempt will result in:
- Immediate termination of all Services
- Permanent ban from NASET programs
- Legal action to recover amounts owed
- Reporting to credit bureaus or relevant professional organizations
- Recovery of all legal and collection costs
5. Intellectual Property Rights
5.1 Ownership
All materials, content, and intellectual property in the Services are the exclusive property of NASET or its licensors, protected by copyright, trademark, trade secret, and other laws.
5.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use only.
5.3 Prohibited Uses
You may not:
- Share, copy, or distribute materials to third parties
- Record, reproduce, or create derivative works
- Use content for commercial purposes or resale
- Circumvent security or access controls
- Use automated systems to scrape or harvest content
Violations will result in immediate termination and legal enforcement.
6. Code of Conduct
You may not:
- Violate laws or regulations
- Impersonate others or misrepresent affiliation
- Engage in fraud or harassment
- Upload malware or malicious code
- Interfere with or disrupt Services
7. Disclaimer of Warranties
Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. We do not guarantee any particular result, job placement, salary increase, or acceptance of certifications.
8. Limitation of Liability
To the fullest extent permitted by law, NASET will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid for the specific Service in the twelve (12) months prior to the claim.
9. Indemnification
You agree to defend, indemnify, and hold harmless NASET, its officers, directors, employees, agents, and affiliates from any claims, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
10. Termination
We may suspend or terminate your access without notice for violations, non-payment, or at our discretion. No refunds will be provided upon termination.
11. Dispute Resolution
11.1 Mandatory Arbitration
All disputes shall be resolved exclusively through binding arbitration under the American Arbitration Association rules, except for eligible small claims court matters.
11.2 Class Action Waiver
You waive the right to participate in class or representative actions.
11.3 Governing Law & Venue
These Terms are governed by Delaware law. Arbitration or court proceedings shall be in Delaware.
11.4 Limitation Period
All claims must be filed within one (1) year of the cause of action.
12. Modifications to Terms
We may update these Terms at any time. Continued use constitutes acceptance.
13. Severability
If any provision is found invalid, the remainder remains enforceable.
14. Electronic Communications
You consent to receive notices and communications electronically.
15. Force Majeure
We are not liable for delays or failures caused by events beyond our control.
16. Entire Agreement
These Terms constitute the full agreement and supersede all prior agreements.
17. No Exceptions Policy
No employee, contractor, or representative may alter the strict no-refund policy for courses or certifications. Any verbal or written promise of a refund is void and unenforceable.
